Terms of Service

Please read these Terms of Service carefully before adding or using the GitTrack Discord bot ("Service"). Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. By adding the Bot to your Discord server, you agree to be bound by these Terms and our Privacy Policy.

1. Description of Service

GitTrack is a Discord bot that provides notifications and updates from GitHub repositories directly within your Discord server. The Service acts as an intermediary, fetching information via GitHub webhooks and relaying formatted messages to designated channels based on your configuration.

2. User Responsibilities and Conduct

As a user of GitTrack, you are responsible for:

  • Correctly configuring the Bot, including linking appropriate GitHub repositories and designating notification channels.
  • Using the Service only for lawful purposes and in accordance with these Terms, Discord's ToS, and GitHub's ToS.
  • Not attempting to gain unauthorized access, reverse engineer the Bot, subject it to denial-of-service attacks, or use it to distribute spam or malicious content.
  • All activities that occur under your server's configuration of the Bot.

3. Service License and Restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to add, configure, and use the GitTrack Service solely for receiving GitHub notifications within your Discord server.

You may not copy, modify, sell, sublicense, or create derivative works of the Service; use it for the benefit of any third party beyond your own server; or remove any proprietary notices.

4. Third-Party Services

The Service relies on Discord and GitHub. We are not responsible for these third-party services, their uptime, or any changes they make to their platforms that could impact GitTrack. Your use of Discord and GitHub is governed by their respective terms.

5. Intellectual Property

The Service, including its software, code, design, and branding, is the exclusive property of GitTrack and its licensors. Configuration data you provide (Discord server IDs, GitHub repository URLs) remains yours, you grant us a royalty-free license to use it solely to provide the Service.

"GitTrack" and its associated logos are trademarks of GitTrack. You may not use these without prior written permission.

6. Fees and Payment

GitTrack may offer certain features for a fee. Any applicable fees will be clearly communicated before you incur charges. All fees are non-refundable except as required by law. We reserve the right to change fees with reasonable prior notice.

7. Service Availability and Modifications

The Service is provided "AS IS" and "AS AVAILABLE." We do not guarantee uninterrupted or error-free access. We may perform maintenance that could temporarily affect availability.

We reserve the right to modify, suspend, or discontinue the Service or any part of it at any time, for any reason, without liability to you.

8. Termination

You may terminate these Terms at any time by removing GitTrack from all Discord servers you control and ceasing all use of the Service.

We may terminate or suspend your access immediately, without prior notice, if you breach these Terms. Upon termination, we may delete your configuration data subject to our Privacy Policy.

9. Disclaimers

Your use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

We are not responsible for any data loss or corruption that may occur. You are responsible for maintaining your own backups.

10. Limitation of Liability

To the fullest extent permitted by applicable law, GitTrack shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.

11. Indemnification

You agree to defend, indemnify, and hold harmless GitTrack and its affiliates from any claims, damages, or expenses arising from your use of the Service, breach of these Terms, or violation of any law or the rights of a third party.

12. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and GitTrack concerning your use of the Service.

Severability: If any provision is held unenforceable, the remaining provisions continue in full force.

Waiver: Failure by GitTrack to enforce any term does not constitute a waiver of that term.

Assignment: You may not assign these Terms without our prior written consent. We may assign them without restriction.
