Please read these Terms of Service ("Terms", "Terms of Service") carefully before adding or using the GitTrack Discord bot ("Service", "Bot") operated by GitTrack ("us", "we", or "our"). Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.
By adding the Bot to your Discord server or otherwise accessing or using the Service, you ("User", "you", "your") agree to be bound by these Terms and our Privacy Policy (available on our website/support server). If you disagree with any part of the terms, then you do not have permission to access or use the Service. You also agree to comply with the Terms of Service of Discord and GitHub, as applicable, when using GitTrack in conjunction with those platforms.
GitTrack is a Discord bot designed to provide notifications and updates from GitHub repositories directly within your Discord server. The Service acts as an intermediary, fetching information via GitHub webhooks (or other GitHub API mechanisms) and relaying formatted messages to designated channels in your Discord server based on your configuration.
As a user of GitTrack, typically the administrator or a user with appropriate permissions on a Discord server:
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to add, configure, and use the GitTrack Service solely for its intended purpose of receiving GitHub notifications within your Discord server.
You may not: (i) copy, modify, or create derivative works of the Service; (ii) sell, rent, lease, distribute, sublicense, or otherwise transfer rights to the Service; (iii) use the Service for the benefit of any third party, except as permitted for users within your own Discord server; or (iv) remove or alter any proprietary notices on the Service.
The GitTrack Service relies on the availability and functionality of third-party services, primarily Discord and GitHub, including their respective APIs and platforms. We do not control and are not responsible for these third-party services, their uptime, data handling practices, or any changes they may make to their terms, functionalities, or APIs that could impact GitTrack. Your use of Discord and GitHub is governed by their respective terms of service and privacy policies, which you are responsible for reviewing and complying with.
The Service, including the Bot's software, code, design, text, graphics, logos, branding, and any associated documentation or original content (excluding data provided by users or sourced from GitHub/Discord), features, and functionality are and will remain the exclusive property of GitTrack and its licensors, protected by copyright, trademark, and other intellectual property laws.
Data you provide for configuration (such as Discord server IDs, GitHub repository URLs, branch names) remains your data. You grant us the necessary, worldwide, royalty-free license to use, process, and store this configuration data solely for the purpose of providing, maintaining, and improving the Service as outlined in these Terms and our Privacy Policy.
"GitTrack" and its associated logos are trademarks of GitTrack. You may not use these trademarks without our prior written permission.
Currently, GitTrack may be offered free of charge, or we may offer certain features or tiers of service for a fee. If any part of the Service requires payment, the applicable fees, subscription terms, and payment policies will be clearly communicated to you before you incur any charges. All fees are non-refundable except as explicitly stated in our payment policies or as required by applicable law. You are responsible for paying all applicable taxes. We reserve the right to change our fees or introduce new charges upon reasonable prior notice.
We strive to ensure the Service is available and functional but do not guarantee uninterrupted, timely, secure, or error-free access. The Service is provided "AS IS" and "AS AVAILABLE." We may perform maintenance, updates, or upgrades which could temporarily affect availability.
We reserve the right to modify, enhance, suspend, or discontinue, temporarily or permanently, the Service or any part of it (including features or functionalities) with or without notice at any time, for any reason. You agree that we shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.
You may terminate these Terms at any time by removing the GitTrack Bot from all Discord servers you control and ceasing all use of the Service.
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms. Upon termination, your right to use the Service will immediately cease. If your access is terminated, we may, at our discretion, delete your configuration data associated with the Service, subject to our Privacy Policy and data retention practices.
Provisions of these Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
GITTRACK, ITS SUBSIDIARIES, AFFILIATES, AND ITS LICENSORS DO NOT WARRANT THAT: A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; B) ANY ERRORS OR DEFECTS WILL BE CORRECTED PROMPTLY OR AT ALL; C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; D) THE INFORMATION OR NOTIFICATIONS PROVIDED BY THE SERVICE WILL BE ACCURATE, COMPLETE, RELIABLE, OR TIMELY; OR E) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.
WE ARE NOT RESPONSIBLE FOR ANY DATA LOSS OR CORRUPTION THAT MAY OCCUR, INCLUDING LOSS OF CONFIGURATION DATA. YOU ARE RESPONSIBLE FOR MAINTAINING YOUR OWN BACKUPS.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GITTRACK, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON OR RELATED TO THE SERVICE (INCLUDING OTHER USERS OR THIRD-PARTY PLATFORMS LIKE DISCORD OR GITHUB); (III) ANY CONTENT OR INFORMATION OBTAINED FROM OR THROUGH THE SERVICE (INCLUDING NOTIFICATIONS); AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS, CONFIGURATIONS, OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
IN NO EVENT SHALL GITTRACK'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNTS PAID BY YOU TO GITTRACK FOR USE OF THE SERVICE DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM ARISING.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to defend, indemnify, and hold harmless GitTrack and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account or server configuration; b) a breach of these Terms, or c) content you submit, post, transmit, or make available through the Service, or your violation of any law or the rights of a third party.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and GitTrack concerning your use of the Service and supersede all prior or contemporaneous understandings and agreements, whether written or oral, regarding such subject matter.
Severability: If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
Waiver: No waiver by GitTrack of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of GitTrack to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null. We may assign or transfer these Terms, at our sole discretion, without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.
